Case study find Offenses and provide punishment using Digital Security Act 2018

Case 1:
Last 2 years ago, we founded a computer company and we save our information on our Database. Customer information, employee information, manager information and all information saved on our
server. Many types of products have on our company. But 2 days ago someone intentionally entire our server room without permission. Today our employee entire our server room then they show already destroy our server, change our current project source code and damage my personal computer.


Offenses:

• Illegal entry in server room and destroy server.
• Change source code.
• Damager personal computer.
• Entry personal computer.

Punishment:

Section NO 17: ​ Punishment for Illegal Entrance in Critical Information Infrastructure.

(*) The person will be penalized by imprisonment for a term not exceeding 14 (fourteen) years or with fine not exceeding 1 (one) crore taka or with both.

SecondTime​ :

(*) The person will be punished with life-term imprisonment or with fine not exceeding 5 (five) crore taka or with both.

Section NO 18: ​ Illegal Entrance in a computer, digital device, computer system.

(*) The person will be penalized with imprisonment for a term not exceeding 3(three) years or with fine not exceeding 10 (ten) lacs taka or with both.

SecondTime​ :

(*) The person will be penalized by imprisonment for a term not exceeding 3(three) years or with fine not exceeding 10 (ten) lacs taka or with both.


Section NO 19:​ ​ Damage of Computer, Computer System.

(*) The person will be penalized with imprisonment for a term not exceeding 7(seven) years or with fine not exceeding 10 (ten) lacs taka or with both.

SecondTime​ :
(*) The person will be punished with imprisonment for a term not exceeding 10( ten) years of imprisonment or with fine not exceeding 25 (twenty-five) lacs taka or with both.


Section NO 20:​ Computer Source Code Change.

(*) The person will be penalized with imprisonment for a term not exceeding 3 (three) years or with fine not exceeding 3 (three) lacs taka or with both.

SecondTime​ :

(*) The person will be punished with imprisonment for a term not exceeding 5(five) years or with fine not exceeding 5 (five) lacs taka or with both.



Case 2:
We know Facebook is a big and famous social medium. Basically, many persons use this shared information one to another. But sometimes much wrong information shared on some person. Some time any group or organization shared any false information and some people write some false information against liberation war, national flag, etc.
This time it creates some impacts on society. This’s people use fake id or use valid person id without permission. Some days ago one group hack our ‘X’ ministry office server and damage all information.


Offenses:

• Using real id without permission.
• Publishing false information.
• Propaganda against liberation war and National Flag.
• Damage server information for a group.

Punishment:


Section NO 21:​ Punishment for Any propaganda or campaign against liberation war, Cognition of liberation war, Father of the nation, National Anthem or National Flag.

(*) The person will be penalized with imprisonment for a term not exceeding 10 (ten) years or with fine not exceeding 1 (one) crore taka or with both.


SecondTime​ :

(*) The person will be punished with life-term imprisonment or with fine not exceeding 3 (three) crores or with both.


Section NO 25:​ Publishing, sending of offensive, false or fear to induce data-information.

(*) The person will be penalized with imprisonment for a term not exceeding 3(three) years of or fine not exceeding 3(three) lacs taka or with both.


SecondTime​ :

(*) The person will be punished with imprisonment for a term not exceeding 5(five) years or with fine not exceeding 10 (ten) lacs taka or with both.


Section NO 26:​ Punishment for Collecting, Using identity Information without Permission.

(*) The person will be penalized with imprisonment for a term not exceeding 5 (five) years or with fine not exceeding 5 (five) lacs taka or with both.


SecondTime​ :

(*) The person will be penalized with imprisonment for a term not exceeding 7 (seven) years or with fine not exceeding 10 (ten) lacs taka or with both.


Section NO 27: ​ Punishment for committing Cyber-terrorism.

(*) The person will be penalized with imprisonment for a term not exceeding 14(fourteen) years or with fine not exceeding 1 (one) crore taka or with both.

(*) The person will be penalized with life-term imprisonment or with fine not exceeding 5(five) crore taka or with both.
